THE HUMAN RESOURCES VIEWPOINT: |
|
| WHY A LEGAL SERVICE PLAN? Seldom do employees do ask Human Resource people for a legal plan. In fact, when a survey is taken asking employees if they want a legal plan, the answer is often no. But when we ask if employees have specific common problems or needs that require legal advice to resolve, the answer is "Oh yes, I have that kind of a problem." They do not realize that a legal plan provides the service they need to address these problems. Consider: Will any of your employees buy or sell a house this year? |

| WHAT IS A LEGAL/financial PLAN?
A legal/financial plan is administered by a third party administrator who arranges access to legal/financial services by plan members. The administrator has control over quality of services through its selection and supervision functions of the legal network while being accountable to the sponsoring organization for quality service delivery. Legal/financial plans are designed to cover most personal legal needs, not business needs. Of course, the sponsoring organization, is protected through a hold harmless clause, and an employee cannot use the company provided legal plan in an action against the sponsor. Financial counseling is generally included as part of legal plan services. These services, provided through a major national accounting firm, provides strategic rather than tactical advice. Specific stock purchases will not be recommended, but long range planning for retirement, college, tax questions, and other financial questions are addressed. The accounting firm supporting the financial counseling service DOES NOT sell financial products or services to plan members. |

| WHAT TYPES OF PLANS ARE AVAILABLE?
ACCESS PLAN: An ACCESS LEGAL PLAN provides a bundle of legal services for a monthly fee. About 85% of legal needs are handled at this fee level. The monthly fee includes unlimited telephone access to a private attorney, letter writing and phone calls made on the clients behalf by the private attorney, will preparation, document review, and general counsel and advice. Complex issues are handled by a local referral attorney, contracted and supervised by the administrator. With standard rates on file with the administrator, the referral attorney agrees by contract to reduce these standard fees by 25%. Click here to review a typical Access Legal Plan. INSURED PLAN: An INSURED plan pays for all or most legal services that are covered by the plan. Generally the monthly premium is the extent of the cost of the plan for the participant. Some plans place a cap on certain contested matters beyond which the member pays. A member of an INSURED plan may use a network attorney, or any other attorney. When using a non-network attorney, the member is reimbursed according to a prescribed schedule. Insured plans generally require an employee group above a minimum size. These negatively impact an employers health care costs. A truly troubled employee can be a major business expense. Just as preventive medicine makes sense, so do employee assistance, wellness, and prepaid legal/financial plans which catch problems when they are small. All are successful at increasing job performance, attendance, and reducing costs. |
|
| WHAT IS THE MONTHLY COST PER EMPLOYEE?
Legal plans offered through employers will range from $10 or less to about $20.00 per employee per month. The monthly fee will be paid either by the employee through payroll deduction, or it can be paid in whole or in part by the employer. The cost is determined by the type of plan, the size of the employee group, and who pays the monthly fee. |
